Toluca, Méx. Luego de 344 días de permanecer en plantón frente a la puerta principal de la sede del Poder Ejecutivo Estatal, las mujeres que conforman el colectivo “Haz Valer mi Libetad”, levantaron el campamento para iniciar una nueva etapa en su lucha jurídica y social para lograr la liberación de sus esposos, hermanos e hijos que se encuentran “injustamente presos”.
Tras sostener una reunión con la gobernadora Delfina Gómez Álvarez, en la que estuvieron presentes, el titular del Poder Judicial, Ricardo Sodi Cuellar, el fiscal de Justicia del estado, José Luis Cervantes Martínez y la comisionada estatal de derechos humanos, Mirna García Morón, este colectivo logró que las autoridades asumieran el compromiso de revisar cada uno de los expedientes de sus parientes para ver la posibilidad legal de que estas personas recuperen su libertad.
En el encuentro participó Daniel Placido, un joven de la comunidad de San Pedro Totoltepec, del municipio de Lerma que estuvo preso más de ocho años acusado del delito de secuestro y sentenciado a 70 años de prisión, pero gracias a que se revisó su expediente y se comprobó que hubo irregularidades en su proceso y violaciones a sus derechos humanos, hace una semana recuperó su libertad.
“En el gobierno del estado estamos trabajando para que los derechos humanos sean una realidad. Desde el primer día que llegó la gobernadora Delfina Gómez, escuchó los reclamos, la voz y el corazón de quienes a través de los colectivos, exigían justicia para sus familiares. La propia gobernadora acudió al campamento, para escuchar de viva voz sus demandas y les dijo que habría toda la voluntad y acción necesaria para hacer justicia en los casos que así lo permita la ley”, dijo el secretario general de gobierno, Horacio Duarte, quien apuntó que después de un riguroso análisis jurídico , se logró encontrar la salida para hacerle justicia a quienes están injustamente presos.
Las autoridades indicaron que este encuentro representa un paso significativo para que el acceso a la justicia sea una realidad, y con ello “borrar la idea de que solo los que tienen dinero pueden tener justicia porque pueden tener buenos abogados, la gobernadora quiere que todos puedan tener acceso a la justicia no por su condición económica, sino por ser personas”.
La gobernadora Delfina Gómez reitero su compromiso, de atender en el marco de las facultades que la ley le otorga y a través de las instancias competentes, los casos que ameriten la intervención del gobierno estatal en la defensa de las causas justas, particularmente de personas pertenecientes a los grupos en condición de vulnerabilidad.
“Les pido que tengan esa paciencia y que puedan entender que hay actos o situaciones que lamentablemente no son fáciles de dar una atención cuando efectivamente existe un delito, porque también queremos ser muy honestos: lo que se pueda arreglar en el marco de la justicia, en el marco de los derechos humanos tengan plena seguridad de que avanzará, pero tampoco nos pidan imposibles porque algo que también quiere el Gobierno es no caer en situaciones que estén violentando la aplicación de la ley”, dijo Delfina Gómez.
El abogado Antonio Lara Duque, representante de este colectivo sostuvo que ahora se inicia una nueva etapa para revisar, con una nueva óptica los casos de estas personas que están injustamente presas. El colectivo tiene un listado donde hay una veintena de personas que por situación de pobreza están en la cárcel, sin haber cometido un delito o por que les fabricaron una acusación y no se pudieron defender.
“Nuestra prioridad ahora son estas 20 personas, pero no podemos cerrar los ojos de que este es, y ha sido, un problema estructural y que hay muchas más personas injustamente presas. Ahora lo que viene es sentar las bases legales para que estos casos ya no se repitan y se pueda lograr la libertad de muchas personas”.
Lara Duque señaló que habrá mesas semanales entre el colectivo y las autoridades para ir revisando caso por caso, pero también se avanzará en la confirmación de iniciativas para perfeccionar la ley.
